LaCantina Doors, Inc. (“LCD”)
We accept orders only on the basis that you have read our terms and conditions and that placing your order confirms that you have read and accepted our terms and conditions.
Quotes and Pricing
An initial quote does not include crating and delivery charges and sales taxes as applicable unless indicated. Estimates of these costs are provided upon request. Prior to order placement a Quote/Contract is provided including crating and delivery charges and applicable sales taxes and reflecting any product changes requested by customer and approved by LCD. Quotes are good for thirty (30) days. LCD may re-price an expired quote and reserves the right to change prices without notice. Customer shall verify the completeness of the Quote/Contract and LCD is not responsible for additional items omitted from the Quote/Contract signed by the customer whether implied or otherwise suggested.
Orders
The following are required to place an order:
- signed and dated Quote/Contract
- signed and dated LCD Order Form;
- receipt by LCD of required payment by LCD corporate HQ, and
- acceptance/approval of order by LCD Corporate Headquarter.
The LCD Order Form outlines the specifications of each door system included in a customer’s order. Check sizes and specifications on the LCD Order Form carefully and agree to your Quote/Contract. The LCD Order Form is confirmation of the door system to be manufactured and any mistake not corrected is the customer’s responsibility. Orders can be changed or cancelled only with LCD’s consent. If the order is changed or cancelled after release for production the change or cancellation fee will be based on manufacturing costs incurred, including reasonable mark-up for overhead and profit as determined by LCD. All orders must be apprvoed by LCD HQ prior to submitting into production.
Payment and Terms
Payment and Terms Payment can be made to LCD via check or electronic funds transfer. Visa or MasterCard are also available upon request and acceptance by LCD. Terms are 65% payable on order, balance due prior to shipment (unless otherwise stated). All payments are to be received by LCD Corporate HQ, outside sales staff are not permitted to receive any form of payment. No deliveries or shipments leave LCD's facility until fully paid and LCD reserves the right to withhold release of product until funds clear bank. All goods shall remain LCD property until paid for in full. LCD reserves the right to reclaim product not fully paid for. If collection action is necessary, customer shall pay all associated collection agency costs and legal fees. Interest will be charged on all overdue accounts. LCD collects sales taxes that apply to a customer's shipment. For resellers a current signed resale card must be on file or sales tax will be charged. The customer will pay any taxes not invoiced. Delivery date provided is an estimate only and LCD will not be liable for failure to deliver on such date. Storage fees apply for shipments deferred at customer’s request for more than fifteen (15) days. All deliveries are curbside service only and require help unloading, including removal of exterior packaging materials and carrying each door panel and frame component off the truck. Doors and Frames are shipped knocked down for jobsite assembly and installation. Door panels and frame components are heavy and care should be taken. Product is crated and shipped via common carrier. Customer shall assist LCD with all freight claims with carrier. On receipt inspect the shipment immediately before the truck leaves. When product is received damaged customer must notify shipping company, contact LCD customer service immediately and send picture of damage. Receipt of freight damaged product does not absolve customer of full payment for the product.
Title and Risk of Loss
Title to products passes from LCD to Customer on shipment from LCD’s facility. Loss or damage that occurs during shipping by a carrier selected by LCD is LCD’s responsibility. Loss or damage that occurs during shipping by a carrier selected by you is your responsibility.
Storage and Finishing
Doors and frames must be stored in a protected area away from external elements and should not be subject to abnormal or sudden changes in temperatures. Finish door systems within seven (7) days of receipt with at least two coats of a high quality sealer suitable for exterior application. Protect door system from drywall and stucco work and keep debris out of track. Failure to comply with these guidelines will void product warranty.
Services & Installation
LCD pricing does not include any post-shipment services such as installation, finishing or non-warranty service. Customer has full responsibility for this work. Installation guidelines are provided with each door system and additional information may be obtained by contacting LCD. Door system installation or service work should only be performed by a suitably experienced professional.
Warranty and Disclaimer of Liability
Except as described in LCD’s warranty, LCD shall not be liable for any other costs, expenses, claims or damages of any kind howsoever caused, whether foreseeable or not, including (without limitation) any direct, indirect, consequential, incidental or special damages. Liability is limited to the cost of the defective part, but never more than the original contract price.
Building Codes, Engineering and Design Considerations
Interpretation of building code requirements is the sole responsibility of the customer. LCD door systems are top hung and require an adequate header and fixing to support the weight of the doors and frame without deflection. Consult with a registered architect and engineer. LCD reserves the right to improve products, make changes in specifications, designs and options without prior notice and without incurring obligation.
Other Terms
LCD and customer agree to submit any dispute in either the state or federal courts in San Diego, California. Unless agreed to explicitly in writing, all terms, outlined above, shall govern the sale of our products.
